Welcome to LHV Apparel. LHV Apparel is a DBA of Ebene Gold Notaries LLC. In these Terms of Service, “LHV Apparel,” “we,” “us,” and “our” refer to Ebene Gold Notaries LLC, doing business as LHV Apparel.

Ebene Gold Notaries LLC operates this store and website, including all related information, content, features, tools, products, and services, to provide you with a shopping experience (the “Services”). LHV Apparel is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully. They include important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access the Services.


SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you confirm that you are at least the age of majority in your state or province of residence. If you allow any of your minor dependents to use the Services on devices you own, purchase, or manage, you consent to their use of the Services and are responsible for their activity.

To use the Services, including browsing the store or purchasing our products, you may be asked to provide information such as your email address, billing information, payment information, and shipping information. You agree that all information you provide is accurate, current, and complete, and that you have the right to provide it.

If you create an account, you are responsible for keeping your account credentials secure and for all activity under your account. You may not transfer, sell, assign, or license your account to another person.


SECTION 2 – OUR PRODUCTS
We make reasonable efforts to display our products and services accurately in our online store. However, colors and product appearance may vary depending on your device, screen settings, and configuration.

Please review each product’s description, images, available options, and sizing information carefully before placing your order. Product details, availability, pricing, and images may be updated from time to time.

We may discontinue products, limit quantities, or limit sales to particular people, geographic regions, or jurisdictions when necessary. We will make reasonable efforts to keep product information current and accurate.


SECTION 3 - ORDERS

When you place an order, you are submitting a request to purchase our products. An order is accepted when payment has been processed and we send you an order confirmation.

LHV Apparel may decline, modify, or cancel an order if a product is unavailable, information on the store is inaccurate, payment cannot be processed, or we identify suspected fraud or another issue that prevents us from fulfilling the order. If we make a change or cancel an order, we will attempt to notify you using the email address, billing address, or phone number provided with the order.

Because our products are made to order, cancellation requests may not be possible once an order has entered production. Your purchases are subject to our Refund Policy.

You confirm that your purchases are for personal or household use and not for commercial resale or export.


SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions may change before an order is accepted. The price charged for a product or service will be the price displayed at checkout and included in your order confirmation email. Applicable taxes and shipping charges may be added at checkout unless otherwise stated.

Prices may differ from prices offered through other sales channels or third-party sellers. Promotions may have separate terms and conditions. If a promotion’s terms conflict with these Terms of Service, the promotion’s terms will apply.

You agree to provide current, complete, and accurate billing, payment, shipping, and account information for all purchases. You agree to promptly update your information, including your email address and payment details, so that we can process your transactions and contact you when needed.

You confirm that the payment information you provide is accurate and that you are authorized to use the payment method. You agree to pay all charges associated with your order, including the product price, applicable taxes, and shipping charges.


SECTION 5 - SHIPPING AND DELIVERY

Orders typically ship within 5–7 business days after purchase. Once shipped, most orders arrive within 3–5 business days. Delivery times are estimates and are not guaranteed.

Carrier delays, severe weather, holidays, peak periods, service interruptions, and other events outside our control may extend processing or delivery times. LHV Apparel is not responsible for delays caused by the shipping carrier or events outside our reasonable control.

Once an order has shipped, tracking and delivery updates are handled by the shipping carrier. If your order appears to be delayed or lost, contact us at customerservice@wearlhv.com so we can review the tracking and fulfillment information and help with next steps.

SECTION 6 - INTELLECTUAL PROPERTY

The Services, including their text, displays, images, graphics, videos, audio, trademarks, logos, designs, and overall arrangement, are owned by Ebene Gold Notaries LLC, doing business as LHV Apparel, or by our affiliates, licensors, or other content providers. This material is protected by applicable U.S. and international copyright, trademark, and other intellectual property laws.

These Terms allow you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit material from the Services without our prior written permission, except as permitted by law or expressly allowed in these Terms.

Nothing in these Terms grants you a license or other rights to use the intellectual property of LHV Apparel, Ebene Gold Notaries LLC, Shopify, our licensors, or any third party. Unauthorized use of the Services or their content may violate applicable intellectual property laws. All rights not expressly granted are reserved.

The LHV Apparel name, logo, product and service names, designs, and slogans may be trademarks of LHV Apparel or their respective owners. Shopify’s name, logo, product and service names, and designs are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans belong to their respective owners


SECTION 7 - OPTIONAL TOOLS

We may provide access to tools, features, or services offered by third parties. We do not monitor, control, or operate these third-party tools, and providing access does not mean that we endorse them.

Third-party tools are provided on an “as is” and “as available” basis. Your use of them is subject to the third party’s own terms and policies, and you are responsible for reviewing those terms before using the tools.

We are not responsible for issues arising from your use of third-party tools to the extent permitted by law. Any new tools or features we add to the Services in the future will also be subject to these Terms of Service.

The Services may include links to, or embedded functionality from, websites, apps, services, or content operated by third parties. We do not control, monitor, or guarantee the accuracy, availability, or reliability of third-party websites or materials.

If you access a third-party website or service through the Services, you do so at your own risk. Your use of that third party’s website or service is governed by its own terms and policies. We are not responsible for third-party content, products, services, or transactions to the extent permitted by law.

Questions, complaints, or concerns about third-party products or services should be directed to the applicable third party.


SECTION 9 - RELATIONSHIP WITH SHOPIFY

LHV Apparel is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with LHV Apparel, a DBA of Ebene Gold Notaries LLC.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and LHV Apparel, including any injury, damage, or loss resulting from products or services purchased through our store. You release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with LHV Apparel, to the extent permitted by law.


SECTION 10 - PRIVACY POLICY

Personal information collected through the Services is handled according to our [Privacy Policy]. Certain information may also be collected and processed by Shopify under Shopify’s [Privacy Policy]. By using the Services, you acknowledge that you have reviewed these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes information about your access to and use of the Services in order to provide and improve the Services. Information you submit through the Services may be transmitted to and shared with Shopify and service providers, including providers located in countries other than your own, as needed to operate the store and provide services to you.

SECTION 11 - FEEDBACK

If you submit ideas, suggestions, feedback, reviews, photos, videos, or other content to LHV Apparel (“Feedback”), you retain ownership of that content. However, you grant LHV Apparel, a DBA of Ebene Gold Notaries LLC, a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, display, and promote that Feedback in connection with operating, improving, and promoting the Services.

You confirm that you own the Feedback or have all necessary rights and permissions to submit it. You also confirm that your Feedback is accurate, does not violate another person’s rights, and complies with these Terms and applicable law. If you received compensation or an incentive for submitting Feedback, you agree to disclose that where required.

We are not required to keep Feedback confidential, publish it, pay for it, or respond to it. We may monitor, edit, restrict, or remove Feedback that we believe violates these Terms, applicable law, or another person’s rights, or that is unlawful, abusive, threatening, defamatory, obscene, misleading, or otherwise objectionable.

You may not submit Feedback using a false email address, impersonate another person, or misrepresent the source of the Feedback. You are responsible for the Feedback you submit.


SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

We work to keep the Services accurate, but occasional typographical errors, inaccuracies, or omissions may occur in product descriptions, pricing, promotions, shipping charges, delivery estimates, availability, or other information.

We reserve the right to correct errors and update information when needed. If an error affects an order you placed, we may contact you to explain the correction or cancel the affected order. If we cancel an order, we will notify you and refund any payment received for that order to the original payment method.

This section does not limit any rights or remedies available to you under applicable law.


SECTION 13 - PROHIBITED USES

You may access and use the Services only for lawful purposes. You may not use the Services, directly or indirectly:

  • To violate any applicable law, regulation, or rule.
  • For unlawful, fraudulent, malicious, or deceptive purposes.
  • To infringe or violate our intellectual property rights or the rights of others.
  • To harass, threaten, abuse, defame, intimidate, or harm any person.
  • To transmit false or misleading information.

  • To interfere with anyone’s use or enjoyment of the Services or damage the Services, Shopify, or other users.

    You also agree not to:

  • Upload or transmit viruses, malware, or other harmful code.
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without permission.
  • Collect or track another person’s personal information without authorization.
  • Scrape, crawl, or access the Services through unauthorized automated means.
  • Phish, pharm, pretext, or interfere with security features.

  • Attempt to bypass or circumvent the security of the Services or any related website.

    We may suspend, disable, or terminate access to the Services if we reasonably believe these Terms have been violated, subject to applicable law.


SECTION 14 - TERMINATION

We may suspend or terminate your access to the Services, or discontinue all or part of the Services, if you violate these Terms, violate applicable law, misuse the Services, or if action is necessary to protect the Services, Shopify, our customers, or others. We may take immediate action when reasonably necessary, and will provide notice where practical.

Ending your access does not affect any rights or obligations that arose before termination. You remain responsible for amounts due for orders or other obligations incurred before termination.

The provisions that by their nature should continue after termination will survive, including Intellectual Property, Feedback and Reviews, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and this Termination section.


SECTION 15 - DISCLAIMER OF WARRANTIES

Information provided through the Services is for general informational purposes. We make reasonable efforts to keep it accurate and current, but we do not guarantee that all information is complete, accurate, or free from errors.

Except for promises expressly made in these Terms or in an applicable product or store policy, the Services and products offered through the Services are provided on an “as is” and “as available” basis, to the fullest extent permitted by law. Ebene Gold Notaries LLC, doing business as LHV Apparel, disclaims warranties that cannot legally be excluded, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

We do not guarantee that the Services will always be uninterrupted, timely, secure, or error-free. Nothing in this section limits any rights or remedies that cannot be excluded under applicable law. Some jurisdictions do not allow certain warranty exclusions, so some of these limitations may not apply to you.



SECTION 16 - LIMITATION OF LIABILITY

To the fullest extent permitted by law, Ebene Gold Notaries LLC, doing business as LHV Apparel, and its owners, directors, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar losses arising from or related to your use of the Services or products purchased through the Services.

This limitation applies regardless of the legal theory of the claim, including contract, tort, negligence, strict liability, or otherwise, even if we were advised that the loss or damage might occur. It also applies to claims involving errors, omissions, interruptions, or content made available through the Services.

Shopify and its affiliates are included as third-party beneficiaries of the protections provided to them under this section. Nothing in these Terms limits liability that cannot legally be limited or excluded.


SECTION 17 - INDEMNIFICATION

You agree to indemnify and hold harmless Ebene Gold Notaries LLC, doing business as LHV Apparel, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, costs, and reasonable attorneys’ fees arising from or related to:

  1. Your breach of these Terms or any policy incorporated into them;
  2. Your violation of applicable law or another person’s rights; or

  3. Your misuse of or unauthorized access to the Services.

    We will notify you of an indemnifiable claim when reasonably practicable. We may control the defense and settlement of the claim, and you agree to provide reasonable cooperation and information. We will not settle a claim in a way that imposes a non-monetary obligation or admission of wrongdoing on you without your prior written consent, which will not be unreasonably withheld.

    This section does not require you to indemnify a party for losses caused by that party’s own negligence, willful misconduct, or breach of these Terms, to the extent prohibited by applicable law.


SECTION 18 - SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law and the unenforceable portion will be severed. The remaining provisions will continue in full force and effect.


SECTION 19 - WAIVER; ENTIRE AGREEMENT

If we do not immediately enforce a right or provision of these Terms, that does not mean we waive our right to enforce it later.

These Terms, together with the policies and operating rules posted on our website or incorporated by reference, form the entire agreement between you and Ebene Gold Notaries LLC, doing business as LHV Apparel, regarding your use of the Services. They replace any prior or contemporaneous agreements, communications, or proposals, whether written or oral, including earlier versions of these Terms.

These Terms will be interpreted fairly and in accordance with applicable law. No ambiguity will automatically be interpreted against either party.


SECTION 20 - ASSIGNMENT

You may not transfer or assign these Terms, or your rights or obligations under them, without our prior written consent. Any attempted transfer that violates this section is void.

We may transfer or assign these Terms and our rights and obligations without your consent in connection with a merger, reorganization, sale of the store or its assets, or transfer to an affiliated company. We will not use this section to reduce any rights or protections you have under these Terms or applicable law.



SECTION 21 - GOVERNING LAW

These Terms and any dispute arising from or related to the Services will be governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where applicable law provides otherwise.

Any legal proceeding related to these Terms or the Services will be brought in the state or federal courts located in the county where the principal office of Ebene Gold Notaries LLC, doing business as LHV Apparel, is located, unless applicable law requires another venue. You and Ebene Gold Notaries LLC consent to the jurisdiction and venue of those courts.

Nothing in this section limits any consumer rights or protections that cannot legally be waived.

Headings in these Terms are included for convenience only. They do not limit, define, or otherwise affect the meaning or interpretation of any provision.

SECTION 23 - CHANGES TO TERMS OF SERVICE

You can review the current version of these Terms of Service on this page.

We may update these Terms from time to time to reflect changes to the Services, our business, or applicable law. We will post the updated version on our website and include its effective date. If a change materially affects your rights or obligations, we will provide notice when required by applicable law.

Changes will apply prospectively from their effective date and will not alter the terms that applied to an order you placed before the change, unless applicable law requires otherwise. Your continued use of the Services after the effective date means you accept the updated Terms. If you do not agree with the updated Terms, you should stop using the Services.
